Supported Decision-Making (SDM) Agreement

     A Supported Decision-Making (SDM) Agreement is a legal tool that allows individuals with disabilities to make their own choices with help from trusted supporters. These supporters may be family members, friends, or professionals who assist the individual in understanding information and exploring options - but the supporters do not have the legal authority to make decisions on the individual's behalf.

     An SDM Agreement can be established once an individual with a disability turns 18 years old, the age at which they are legally considered an adult. Importantly, the individual with the disability retains full legal authority to make their own decisions. The supporters simply provide guidance, information, and support.

     Supporters may have access to private information, such as medical, educational, or financial records, but only to help the individual review and understand the information. Supporters do not have legal authority to act independently or override the individual's choices.         

     There is no "one-size-fits-all" SDM agreement. Each agreement can be customized to meet the specific needs and preferences of the individual. It may be broad or narrow in scope and may include support in areas such as: choosing where to live, making decisions about medical care, services, and supports, managing money and budgeting, exploring employment opportunities, and participating in social activities and maintaining relationships.

     SDM Agreements are now recognized in Louisiana law as a less restrictive alternative to tutorship, interdiction, or a power of attorney - particularly for individuals with mild intellectual disabilities.

     An SDM Agreement promotes self-determination and independence, helping individuals transition into adulthood while still receiving the support they need to make informed decisions.
